Welcome to Vivytal. By accessing or using our website and services at vivytal.com ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.
1. Description of Service
Vivytal is a health and wellness tracking platform that allows users to log health metrics, receive AI-generated nutritional and exercise recommendations, and manage personal health data. The Service is provided by Vivytal, based in Indianapolis, Indiana.
2. Eligibility
You must be at least 18 years old to use this Service. By creating an account, you represent that you meet this requirement.
3. Accounts
You are responsible for maintaining the confidentiality of your account credentials (email and PIN). You agree to notify us immediately of any unauthorized use of your account. We are not liable for any loss arising from unauthorized access to your account.
4. Not Medical Advice
The Service provides general health information and AI-generated suggestions for informational purposes only. It is not a substitute for professional medical advice, diagnosis, or treatment. Always consult a qualified healthcare provider before making health decisions. Vivytal does not provide medical advice.
5. Subscriptions and Payments
Vivytal offers a free tier and a paid Pro plan. Pro subscriptions are billed monthly through Stripe. You may cancel at any time through your account settings. Upon cancellation, you retain access through the end of your billing period. Refunds are not provided for partial billing periods.
6. User Data
You retain ownership of all health data you enter into the Service. By using the Service, you grant Vivytal a limited license to process your data solely to provide the Service. We do not sell or share your personal health data with third parties. See our Privacy Policy for details.
7. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to gain unauthorized access to any part of the Service
- Interfere with or disrupt the Service
- Share your account with others
8. AI-Generated Content
Nutritional plans, exercise recommendations, and health insights are generated by artificial intelligence. While we strive for accuracy, AI-generated content may contain errors or may not be appropriate for your specific health situation. Use such content at your own discretion.
9. Limitation of Liability
To the fullest extent permitted by law, Vivytal shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.
10. Termination
We may suspend or terminate your account at any time for violation of these Terms. You may delete your account by contacting us. Upon termination, your data will be deleted in accordance with our Privacy Policy.
11. Changes to Terms
We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated Terms.
12. Governing Law
These Terms are governed by the laws of the State of Indiana, without regard to conflict of law principles.
